We wish to bring to your attention the following:
S.C. SCIO INTERNATIONAL S.R.L has registered with the Office for Harmonization in the Internal Market the community trade mark "SCIO INTERNATIONAL", "EDUCTOR SCIO", "CLASP32", "SCIO THETA".
Based on the community trade mark registration, our company has filed with the World Intellectual Property Organization (WIPO) an international application for registering the trade marks "SCIO INTERNATIONAL", "EDUCTOR SCIO", "SCIO THETA" in TR (Turkey), CH (SWITZERLAND), AU (Australia), JP (Japan) and U.S. (United States of America).
The trade marks are registered in the European Union and for international protection in TR (Turkey), CH (SWITZERLAND), AU (Australia), JP (Japan) and U.S. (United States of America), for the following products and services (according to NICE classification):
– Products in class 10: medical apparatus, instruments and products;
– Services in class 35: distribution of medical apparatus, instruments and products;
– Services in class 37: repair, maintenance, installation services of medical apparatus, instruments and products.
According to the provisions of the Madrid Agreement Concerning the International Registration of Trademarks and Common Regulations under the Madrid Agreement:
Article 4
[Effects of International Registration]
(1) From the date of the registration effected at the International Bureau in accordance with the provisions of Articles 3 and 3ter, the protection of the mark in each of the contracting countries concerned shall be the same as if the mark had been filed therein direct. The indication of classes of goods or services provided for in Article 3 shall not bind the contracting countries with regard to the determination of the scope of the protection of the mark.
This means that one is not allowed, without our approval, to physically or virtually put on the market, within the European Union, TR (Turkey), CH (SWITZERLAND), AU (Australia), JP (Japan) and US (United States of America) the goods for which the trade mark was registered within the European Community and its international application. Furthermore one is not allowed, without our approval to supply the services for which the trade mark was registered within the European Union, TR (Turkey), CH (SWITZERLAND), AU (Australia), JP (Japan) and US (United States of America), under an identical or similar name with our trade mark "SCIO INTERNATIONAL", "EDUCTOR SCIO" and "SCIO THETA".
By using this trade mark or a part of it, in our case SCIO, SCIO THETA and/or EDUCTOR SCIO, both in your current activity and your website, you mislead and confuse the customers. It is more than obvious that, via this illegal use, you practice unfaithful competition and bring serious prejudices to our company.
SCIO International SRL, as owner of the "SCIO INTERNATIONAL", "SCIO THETA" and "EDUCTOR SCIO" trademarks, hereby authorizes ONLY OUR REPRESENTATIVES, all current and future uses of the "SCIO INTERNATIONAL", "SCIO THETA" and "EDUCTOR SCIO" trademarks in their activity of: distribution and selling, marketing, promotion of the goods bearing the above mentioned trademarks, as well as training activities for the following period of time: availability period of trade mark.
